On Wednesday 22 May 2024, the Embassy of Italy in Beijing organised the seminar “Data Compliance and Protection for Businesses in China”, in cooperation with the Italian Cultural Institute (IIC), the China-Italy Chamber of Commerce and the EU SME Centre. During the event, Chinese and Italian academics and legal experts examined from different angles the Chinese legal framework on data governance and its potential challenges for European companies.
The seminar opened with speeches by Marco Midolo, Head of the Economic and Commercial Office of the Italian Embassy in Beijing, and Michaël De Boer, First Secretary of the Trade section of the European Union Delegation to China.
Barbara Li, Partner at Reed Smith Beijing Office, and Liam Jia, Team Leader at the EU SME Centre, then presented the current framework governing data in China, with a focus on the regulations on cross-border data flows and their implications for European companies.
Marina Timoteo, Professor at the University of Bologna, discussed the emergence of data as a legally regulated asset, as well as its use as a business asset and collateral for financing. Wang Yukai, Professor at Tongji University, and Fabio Giacopello, Lawyer at HFG, explored the issues and opportunities arising from the use of data by market players in terms of intellectual property.
